Terms of Use

These terms set out the friendly ground rules for using Elarpet cameras, feeders and the companion app — so you and your pets can enjoy them safely.

1. Acceptance of these terms

These Terms of Use ("Terms") form an agreement between you and Shenzhen Wuyouguoguo E-Commerce Co., Ltd. (深圳市无忧果果电子商务有限公司) ("Elarpet", "we", "us" or "our"). By creating an Elarpet account, setting up an Elarpet device, or downloading, installing or using the Elarpet app, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, please do not use the Elarpet app or devices.

2. The service

"The service" means the Elarpet smart pet cameras and camera feeders (the "devices"), together with the Elarpet companion app for iOS and Android and the related cloud features (collectively, the "service"). The service is provided by Shenzhen Wuyouguoguo E-Commerce Co., Ltd. The service is designed to help you see, talk to, play with and feed your pets remotely — it is intended for pet care and household pet-monitoring use only.

3. Licence

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to download and use the Elarpet app on devices you own or control, solely to set up and operate your own Elarpet device for personal, non-commercial purposes. This licence does not transfer any ownership rights to you. You may not rent, lease, lend, sell, redistribute or sublicense the app, or any part of it, to anyone else.

4. Your account

To use most features you must create an Elarpet account. You agree to provide accurate information and to keep your login credentials confidential. You are responsible for all activity that takes place under your account, and for any people you invite to share access to your devices. Please notify us promptly at elarpet@elarpet.net if you believe your account has been accessed without your permission.

You must be at least 18 years old (or the age of legal majority where you live) to create an account and agree to these Terms.

5. Acceptable use

You agree to use the service lawfully and only as intended. In particular, you agree that you will:

  • use the cameras and feeders only in your own home or property, to monitor your own pets;
  • obtain the knowledge and consent of any other people who live in, work in or visit the area covered by a camera, and respect their privacy and local laws on recording;
  • not use the service to harass, stalk, intimidate or monitor any person, or in any way that infringes the rights of others;
  • not misuse, overload, disrupt or attempt to gain unauthorised access to the service or its systems; and
  • not copy, modify, decompile, disassemble or reverse engineer the app or devices, except to the limited extent permitted by applicable law.

6. Safety — please read carefully

Your pets' safety always comes first. The play and feeding features are wonderful companions to your care, but they come with important limits:

  • Laser play is for fun only. The laser must never be pointed at the eyes of pets or people. Use it as a moving target to chase, supervise play where you can, and stop if a pet seems stressed or over-excited.
  • Treat toss and feeding assist you — they do not replace you. Scheduled portions, treats and reminders are conveniences only. They are not a substitute for proper feeding, constant access to fresh water, regular check-ins and veterinary care. Always make sure someone can attend to your pet when you are away for longer periods.
  • This is not a medical or life-safety device. Elarpet devices are consumer pet-care products. They are not designed or certified for medical, emergency or life-safety use, and must not be relied upon as such.
  • The service can be interrupted. Live video, alerts, treat toss and feeding depend on power, your home network, internet connectivity, third-party services and the device itself. Any of these can fail, so the service may be delayed or unavailable. Do not rely on it as your only means of caring for your pet.
  • Follow the manual. Always set up and operate your device according to the product manual and supervise play and feeding as recommended.

7. Service availability

We work hard to keep the service running smoothly, but it is provided on an "as is" and "as available" basis. We do not promise that the service will be uninterrupted, timely, secure or error-free, or that any defects will be corrected. We may add, change, suspend or remove features, or perform maintenance, at any time. Network coverage, internet access and any data charges from your mobile or internet provider are your responsibility.

8. Warranties and disclaimers

Your device may come with a separate limited hardware warranty, which is described on our support page and in the box. Except for that limited warranty and any rights you have under mandatory consumer-protection law, the service and the app are provided without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

9. Limitation of liability

To the fullest extent permitted by law, Elarpet and its suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, loss of profits or loss of goodwill, arising out of or relating to your use of (or inability to use) the service. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by our negligence. These limits do not affect your statutory rights as a consumer.

10. Intellectual property

The Elarpet name, logo and other brand marks, together with the app, its software, design, text and graphics, are owned by Shenzhen Wuyouguoguo E-Commerce Co., Ltd. or its licensors and are protected by intellectual-property laws. These Terms do not grant you any right to use our marks without our prior written permission. Video and images you record with your own device remain yours.

11. OEM / ODM engagements

Elarpet also offers bespoke OEM and ODM services for business partners and e-commerce sellers. Any such business-to-business engagement — including white-label hardware, custom apps, packaging and supply arrangements — is governed by a separate written agreement between Elarpet and the partner, not by these consumer Terms. 12. Termination

You may stop using the service and close your account at any time. We may suspend or terminate your access to the service if you breach these Terms, if required by law, or if we reasonably need to in order to protect the service or other users. On termination, the licence granted to you ends and you should stop using the app; the sections that by their nature should survive — such as intellectual property, disclaimers and limitation of liability — will continue to apply.

13. Governing law

These Terms are governed by the laws of the People's Republic of China, without regard to its conflict-of-laws rules. Subject to any mandatory rights you have under the consumer-protection laws of your own country, any dispute arising out of or relating to these Terms or the service will be subject to the jurisdiction of the competent courts in Shenzhen, Guangdong, China. Nothing here limits any non-waivable rights you have where you live.

14. Changes and contact

We may update these Terms from time to time — for example, when we add new features or for legal reasons. When we do, we will revise the "Last updated" date above and, where appropriate, let you know in the app. By continuing to use the service after an update takes effect, you accept the revised Terms.
